By using Inoleap Tourism, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

1. Acceptance of Terms

By accessing, browsing, or using the Inoleap Tourism platform (the "Platform"), including our website, mobile applications, and all related services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use the Platform.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Inoleap Tourism ("Company," "we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the Platform following any modifications constitutes your acceptance of the updated Terms.

2. Definitions

  • "Account" - Your personal user account on the Platform, created during registration.
  • "Booking" - A confirmed reservation for accommodation, tour, experience, or other service listed on the Platform.
  • "Booking Request" - An initial request from a guest to book a listing, pending host approval.
  • "Commission" - The fee charged by Inoleap Tourism for completed bookings (8% total: 5% guest service fee + 3% host commission).
  • "Content" - All text, images, videos, descriptions, reviews, and other materials posted on the Platform.
  • "Escrow" - A secure account where guest payment is held until booking completion or dispute resolution.
  • "Guest" - A user who searches for and books accommodations, tours, or experiences.
  • "Host" - A user who creates listings and offers accommodations, tours, experiences, or services.
  • "Listing" - A property, tour, experience, or service offered for booking on the Platform.
  • "Platform" - The Inoleap Tourism website, mobile applications, and all related services.
  • "User" - Any person who accesses or uses the Platform, including guests and hosts.
  • "Wallet" - A secure account where hosts' earnings are deposited and from which they can withdraw funds.

3. Account Registration & Eligibility

3.1 Eligibility Requirements

To use the Platform, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into binding agreements
  • Reside in a country where Inoleap operates
  • Provide accurate, complete, and truthful information
  • Maintain current contact information

3.2 Registration Process

To create an account:

  1. Provide your email address and create a secure password
  2. Verify your email address via confirmation link
  3. Provide your phone number and verify via SMS code
  4. Complete your profile with accurate personal information
  5. Accept these Terms & Conditions

3.3 Account Verification

  • Email Verification: Required to create listings and accept bookings
  • Phone Verification: Required to create listings and accept bookings
  • Identity Verification: Optional but recommended for hosts to earn Trust Badges

3.4 Account Security

You are responsible for maintaining the confidentiality of your password, all activities that occur under your account, notifying us immediately of unauthorized access, and complying with all applicable laws and regulations. We are not liable for unauthorized access resulting from your failure to protect your password.

3.5 Account Termination

We may terminate or suspend your account if you violate these Terms, engage in fraudulent or illegal activity, violate our Community Guidelines, pose a safety risk to other users, or fail to respond to verification requests.

4. User Responsibilities & Acceptable Use

4.1 Prohibited Conduct

You agree NOT to engage in:

  • Fraudulent Activity: Misrepresent your identity, create fake listings/bookings, engage in payment fraud, manipulate reviews, or use the Platform for money laundering.
  • Abusive Behavior: Harass, threaten, or discriminate against other users, post abusive content, send spam, or impersonate others.
  • Illegal Activity: Violate any laws, facilitate illegal transactions, sell prohibited items, or violate intellectual property rights.
  • Platform Abuse: Attempt to hack, scrape data without permission, use bots, or bypass security measures.
  • Unsafe Practices: Meet in unsafe locations or ignore safety guidelines.

4.2 Communication Standards

All communication must be respectful, professional, honest, and conducted through Platform messaging (not external channels for transactions).

5. Platform Services Description

5.1 Listing Management

The Platform allows hosts to create and manage tourism listings, upload photos, set pricing, manage requests, communicate, and receive payments.

5.2 Booking System

Guests can search listings, submit requests, communicate, make secure payments through escrow, leave reviews, and report issues.

5.3 Payment Processing

We facilitate secure payment processing, escrow system for booking protection, wallet system for host earnings, and withdrawal processing.

6. Intellectual Property Rights

All content, design, functionality, and intellectual property of the Platform are owned by Inoleap Tourism. You may not reproduce, modify, or reverse engineer the Platform. You retain ownership of content you create (listings, photos, reviews), but grant us a worldwide license to display and distribute it.

7. User-Generated Content

Hosts are responsible for the accuracy of listings and legal compliance. Reviews must be honest and based on personal experience. We reserve the right to moderate, remove, or flag content that violates these Terms.

8. Payment Terms & Refund Policy

8.1 Commission Structure

Inoleap charges the following fees on completed bookings:

  • Guest Service Fee: 5% (added to booking price, paid by guest)
  • Host Commission: 3% (deducted from host payout)
  • Total Platform Fee: 8%

8.2 Escrow & Payouts

Guest payments are held in escrow. Payments are released to the host's wallet when the guest confirms check-in satisfaction. Hosts can withdraw funds (Minimum: 5₾, Maximum: 50₾/transaction, Daily limit: 100₾). Processing takes 3-5 business days.

8.3 Refund Policy

Refunds depend on the host's cancellation policy (Flexible, Moderate, Strict, or Non-Refundable) as detailed on the listing page.

9. Third-Party Services & Links

The Platform integrates with third-party services (Stripe, PayPal, AWS, Google Maps, etc.). We are not responsible for third-party services' privacy practices or functionality, nor for the content of external websites linked from the Platform.

10. Privacy & Data Protection

We collect necessary information to provide services. We protect data using encryption, strict access limits, and compliance with GDPR/CCPA. We do not sell your data. For full details or to exercise your rights, please contact [email protected].

11. Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS". TO THE MAXIMUM EXTENT PERMITTED BY LAW, INOLEAP SHALL NOT BE LIABLE FOR indirect, incidental, special, or consequential damages, lost profits, or business interruption.

12. Indemnification

You agree to indemnify and hold harmless Inoleap Tourism from any claims, damages, or expenses arising from your use of the Platform, your listings, or your violation of these Terms or laws.

13. Dispute Resolution & Governing Law

These Terms are governed by the laws of Georgia. Disputes should be resolved via: 1. Negotiation, 2. Mediation (Admin intervention), 3. Final Admin Decision. Unresolved disputes shall be handled through binding arbitration in Georgia. Class action lawsuits are waived.

14. Termination & Suspension

You may delete your account at any time if there are no active bookings. We may suspend or terminate accounts for violations, fraud, or safety risks. Termination results in listing removal and cancellation of active bookings.

15. Modifications to Terms

We may modify these Terms at any time. We will notify you of significant changes. Continued use of the Platform constitutes acceptance.

16. Severability

If any provision of these Terms is found to be invalid, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
